A MAN who attacked his partner in their garden while subject to a suspended jail term for earlier violence has had his sentence changed for the second time.

When Carl Humphries, 25, was sentenced in February for assaulting his then girlfriend, he was placed on a six months electronically monitored curfew at his home in Woodchester, near Stroud.

But last month he returned to Gloucester Crown Court and had the curfew conditions changed to allow him to stay at his new girlfriend's mother's house in Kingsway, Dursley.

However, he has been back before the court for a third time - because his relationship has ended and he is no longer welcome at the Kingsway address.

Recorder Robert Waddington varied his sentence for a second time by lifting the curfew order altogether and replacing it with 30 hours of unpaid work.

Originally Humphries had been given a three-month jail term suspended for two years and had been ordered to do 80 hours of unpaid work with the six months curfew for assault occasioning actual bodily harm.

The electronically monitored curfew was from 8pm-6am every night.

Defending solicitor Steve Young told Recorder Waddington: "My client's relationship with his partner has broken down and he is no longer welcome at the curfew address.

"He effectively has no address and is staying with friends."

The court was told at the original hearing that on July 24 last year Humphries got into an argument with his partner and threatened to shut her and their young son into the house and set it on fire.

She told him she wanted to end their relationship and at lunchtime that day they were seen by neighbours in the garden.

"They were arguing and a neighbour saw what was taking place," said prosecutor Martin Steen. "Without warning he suddenly hit her three times to the side of the head, knocking her to the ground. He then kicked her in the left thigh.

"Neighbours intervened and the police were called, He was bailed on a condition not to contact her but the next evening he went to the address where she was staying. He said he had only gone there to talk about their son."

At the time of the offence, Humphries was subject to a 40 weeks suspended jail term for stabbing a neighbour with a steak knife.
